Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of VooMoa — including the website at https://voomoa.com and our companion mobile applications (together, the “Service”) — operated by Moa Bilgisayar Yazılım İnşaat Sanayi ve Ticaret Limited Şirketi (“Moa Bilgisayar”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf.

The Service is not directed at children under 13 (or the minimum age required in your country) without appropriate consent.

3. The Service

VooMoa provides an interactive language-learning experience, including chapter maps and subcategories, adaptive questions, progress tracking, optional guest play, optional sign-in, retention features such as streaks and daily goals, weekly leagues/leaderboards, and in-game features such as hearts, coins, and hints. Mobile apps may also include advertisements and optional in-app purchases.

Features available on web and mobile may differ. We may add, change, suspend, or remove features at any time. We do not guarantee uninterrupted or error-free operation. Maintenance, updates, or circumstances beyond our control may affect availability.

4. Accounts and guest play

• Guest play — You may use the Service without creating a named account. Progress may be tied to your browser or device. Guest data may be lost if you clear cookies/app data, change devices, or use private browsing.
• Registered accounts — If you sign in with email and password, Google, or a passkey, you are responsible for maintaining access to those credentials or devices and for activity under your VooMoa profile.
• Linking accounts — When you link Google or register a passkey (or upgrade a guest session to a full account), we will associate your progress with that account subject to our systems and these Terms. If you sign in to an existing account from a guest session, you may switch to that account’s saved progress.
• Passkeys — Passkeys are tied to your device and platform. You are responsible for securing the device and account used to create or use a passkey. We cannot recover a passkey if you lose access to all registered devices.
• Email verification — Where required, you must verify your email address to unlock certain account features.
• Accuracy — You must not impersonate others or provide misleading information when using sign-in features.
• Account deletion — Where available, you may request deletion of your account from within the Service. Confirmed requests typically enter a grace period before permanent deletion; you may cancel during that period if the Service allows. Admin accounts and certain restricted cases may not be self-deletable.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws;
• Attempt to cheat, manipulate scoring, league XP, or rankings; exploit bugs; or circumvent hearts, hints, anti-cheat, ads, purchases, session tokens, or rate limits;
• Use bots, scrapers, automated scripts, modified clients, or unauthorized tools to access the Service or its APIs;
• Tamper with device attestation, store receipts, or ad-reward verification;
• Reverse engineer, decompile, or attempt to extract source code or underlying algorithms except where law permits;
• Interfere with or disrupt the Service, servers, or networks;
• Harass, abuse, or harm others, or upload harmful or offensive content (including leaderboard display names);
• Resell, sublicense, or commercially exploit the Service without our written permission.

We may investigate violations and take action including warning, restricting features, resetting progress, removing leaderboard nicknames, suspending access, or terminating your use of the Service.

6. Virtual items, ads, and purchases

The Service may include virtual items (such as hearts, coins, hints, or similar) that have no real-world monetary value, are not property, and are not redeemable for cash. We may modify earn rates, costs, limits, or availability of virtual items at any time. Except where required by law, virtual items are non-refundable and non-transferable.

Mobile apps may show advertisements (including rewarded ads that grant in-game benefits). Ad availability and rewards may change. Abuse of ad flows may result in reward denial or account restrictions.

Optional in-app purchases are processed by the relevant app store (for example Google Play). Store terms, payment methods, and refund policies apply. We are not responsible for store billing decisions. Purchased virtual items are licensed to you for use in the Service under these Terms and may be revoked if obtained fraudulently.

7. Leagues and leaderboards

Where enabled, weekly leagues award XP for eligible correct answers and may display public rankings using your chosen or automatically assigned display name. Guests may be ineligible. You may opt out of leagues where the Service provides that control. Rankings, seasons, and league rules may change. League participation does not create any entitlement to prizes unless we expressly announce otherwise.

8. Intellectual property

The Service, including software, design, text, graphics, logos, questions, subcategory content, and other materials, is owned by Moa Bilgisayar or its licensors and is protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial learning in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from our content except as expressly allowed by law or with our written consent.

9. Third-party services

The Service may integrate or link to third-party services (such as Google Sign-In, WebAuthn/passkeys, Cloudflare Turnstile, Firebase Analytics and Crashlytics, Google AdMob, and app-store billing). Your use of those services is subject to their terms and policies. We are not responsible for third-party services or content.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, that learning outcomes will be achieved, that content is complete or error-free, or that defects will be corrected.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOA BILGISAYAR AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY EUROS (€50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING MANDATORY CONSUMER PROTECTION IN YOUR COUNTRY).

12. Indemnity

You agree to indemnify and hold harmless Moa Bilgisayar and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms, except to the extent caused by our wilful misconduct or where prohibited by law.

13. Termination

You may stop using the Service at any time. You may sign out of linked accounts through the Service where available. Deleting cookies, clearing app data, or using a new device may end a guest session without deleting server-side data immediately.

We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, pose a security risk, or if we discontinue the Service. Provisions that by nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” at the top indicates the current version. Material changes may be communicated through the Service where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Disputes shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Türkiye, unless mandatory law grants you the right to bring proceedings in your place of residence.

If you are a consumer in the European Union, you may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. General

• Entire agreement — These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
• Severability — If any provision is invalid, the remainder remains in effect.
• No waiver — Failure to enforce a provision is not a waiver of our rights.
• Assignment — We may assign these Terms; you may not assign them without our consent.
